Under the NSW Aboriginal Procurement Policy, agencies may directly negotiate with an Aboriginal business without running a competitive process, and may do so even where a mandated scheme or panel is in place. Your procurement team can confirm the applicable threshold.

Before the open market
Where Aboriginal businesses are identified as capable of delivering a requirement, agencies should engage with those suppliers before proceeding to the broader market.

Participation requirements
Larger NSW contracts carry a minimum requirement for Aboriginal participation. We work with prime contractors to meet it substantively rather than nominally, as a delivery partner rather than a flow-through.
Commonwealth
Exemption 16
Direct engagement
Commonwealth buyers may procure directly from an Indigenous SME for a contract of any value without a competitive process, provided value for money is demonstrated. A simple quote process is sufficient.
Set-aside
Mandatory Set-Aside
Within the range set by the policy, and for remote-area contracts, you must first offer an Indigenous SME the opportunity to deliver on a value-for-money basis before approaching the open market.

Reporting, handled
Engaging us contributes to your portfolio's Indigenous Procurement Policy targets. We report Indigenous participation, personnel and contract value share at each milestone in the format you need.
